1. Acceptance of Terms

By accessing or using the Capacity Check application ("the Tool"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Tool. These terms apply to all users, including free and paid subscribers.

2. Description of the Tool

The Capacity Check is a self-reflection and self-leadership tool designed to help individuals assess their energy, support, and recovery across key areas of life. It is provided for informational and personal development purposes only.

The Capacity Check is not a medical device, not a clinical assessment, and not a substitute for professional mental health care, therapy, counseling, or medical advice. If you are experiencing a mental health crisis or emergency, please contact a qualified professional or call emergency services.

3. User Accounts

You must create an account to use the Tool. You are responsible for maintaining the security of your account and for all activity that occurs under your account. You agree to provide accurate information when creating your account and to notify us promptly if you believe your account has been compromised.

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this requirement.

4. Acceptable Use

You agree to use the Tool only for lawful purposes and in a manner that does not:

  • Violate any applicable laws or regulations
  • Infringe the rights of any third party
  • Attempt to gain unauthorized access to any part of the Tool or its infrastructure
  • Interfere with or disrupt the Tool's operation
  • Use the Tool to collect data about other users without their consent

5. Subscriptions and Payments

The Capacity Check offers a free tier and a paid Capacity Plus subscription. Subscription fees are billed monthly through Stripe. You may cancel your subscription at any time from your profile settings. Cancellation takes effect at the end of the current billing period — you will retain access to Capacity Plus features until then.

We do not offer refunds for partial billing periods. If you believe you were charged in error, please contact us promptly.

6. Intellectual Property

All content, design, and functionality of the Capacity Check — including the assessment questions, scoring methodology, and written copy — is the property of the Lets Change Forward Foundation and PluggedIn Tools. You may not reproduce, distribute, or create derivative works from this content without written permission.

Your personal assessment data belongs to you. We do not claim ownership of your responses.

7. Disclaimer of Warranties

The Tool is provided "as is" without warranties of any kind, express or implied. We do not warrant that the Tool will be uninterrupted, error-free, or that the results of using the Tool will be accurate or reliable for any particular purpose.

8. Limitation of Liability

To the fullest extent permitted by law, the Lets Change Forward Foundation and PluggedIn Tools shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Tool, even if we have been advised of the possibility of such damages.

9. Changes to These Terms

We may update these Terms of Use from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the Tool after changes are posted constitutes your acceptance of the updated terms.
